Mediation involves an impartial third party assisting the parties to a dispute to reach agreement in relation to various matters, including property settlement and children's arrangements. This is achieved by the mediator facilitating communication between the parties, and assisting them to identify and respond to individual needs and interests, without the initiation of court proceedings.
In other circumstances, the parties may agree to jointly appoint an arbitrator to consider each party's arguments, and then make a decision. In such circumstances, the parties agree prior to the arbitration that they will be bound by the arbitrator's decision. It is often more time and cost-effective to have a matter determined by an arbitrator than through court proceedings.
