In certain situations, one party may be required to provide ongoing financial support to the other party of a marriage or de facto relationship, either on a short term or long term basis. This financial support is based upon an assessment of:
- the applicant's need for financial support/assistance; and
- the other party's capacity to provide financial support/assistance.
Spousal maintenance payments may be ordered in either marriages or de facto relationships, and applications may be considered alongside, or separately from, property settlement proceedings.
DS Family Law are able to provide advice and representation to the applicant in relation to their spousal maintenance claim (or to the respondent in opposing any application).
