In certain situations, one party may be required to provide ongoing financial support to the other party of a marriage or de facto relationship, either on a short term or long term basis. This financial support is based upon an assessment of:
- the applicant's need for financial support/assistance; and
- the other party's capacity to provide financial support/assistance.
Spousal maintenance payments may be ordered in either marriages or de facto relationships, and applications may be considered alongside, or separately from, property settlement proceedings.
