Mediation & Arbitration
This is achieved by the mediator facilitating communication between the parties, and assisting them to identify and respond to individual needs and interests, instead of focusing solely on “positions”.
In other circumstances, the parties may agree to jointly appoint an arbitrator to consider each party’s arguments, and then make a decision. In such circumstances, the parties agree prior to the arbitration that they will be bound by the arbitrator’s decision. It is often more time and cost-effective to have a matter determined by an arbitrator than by the Court.
